Is Cheney right with regards to the CIA probe?

Personally, i think Cheney would be right to sit down somewhere and stay out of the spotlight like Bush. it's not his problem anymore, so let it go. it seems to me he runs the risk on making Obama angry and having an investigation launched against him. he made is point at that conference a several weeks regarding waterboarding in '03. but I guess some people can't help themselves, what say you?
